As a side note, since this case is about our pay, I do have some more input and questions, which no one has inquired about yet. After studying the complex "pay manual" of how the system works, I really hope we get an actual 'base pay' system. In matter of fact, it looks like there is no set base pay which is guaranteed. I'm not even sure minimum wage is guaranteed any longer. We already know we do not get paid for the time when we are "not logged into the phones" as stated in my signed declaration. Comparing it to my pay records, I've come to the conclusion that: We also do not get paid for "available" time, which means even when we are logged into the phones; ready to take calls but not on a call. Most of the time we have back-to-back calls but sometimes, mostly holidays or when Verizon Wireless just isn't sending us calls, is when no calls are coming in, so we have several minutes of "available" time before another call. There is no mention of a subsidy, minimum, or any type of pay for "available" either.
Please correct me if I am wrong and I spoke with another individual to confirm, then was informed our actual "Achievement Based Compensation", the performance/incentive pay, supplements for "available" time. It sounds accurate but is that even legal with a minimum wage law? Let us look at a top performing agent, instead of focusing on myself whom is a low-tier 'ABC' agent that uses "System down" and lots of "Call work" (keeping my pay close to minimum wage as 'ABC' cannot go lower than minimum wage).
Here is the scenario: A top-tier agent on 'ABC' pay works a 40 hour week. The agent has 29 hours as 'ABC' while on call. 10 hours are "logged" as subsidized minimum wage. This agent then has 1 hour unaccounted for due to "available", since he/she doesn't need time for notes or followups. If I was a manager and this agent came to me, the only response would be is that the ~$13/hour from top-tier ABC is supplementing that 1 hour of "available" time where the agent was waiting for a call.
When we are coded and logged from the phones as:
1. "System down" / "Meeting" / "Coaching" / "Training" / "Floor support" / "Personal" / "Break"; We are subsidized at minimum wage.
2. "Lunch" or "Sign out" [Just realized, also "Available".]; We are paid nothing.
3. "Call work", which puts a hold on incoming calls; Seems similar as "Inbound call" and the more we have, lowers our 'ABC' pay tier.
4. If logged into the phone to call back someone then your put onto "Call work", meaning a followup call lowers your 'ABC' performance pay.
5. "Inbound call" is our 'ABC', a constant fluctuating tiered pay scale, based off of how many calls and how fast we handle those calls.
Personally, if I could choose an outcome for this court case; because I'm still working at and like working at Xerox, it wouldn't be to win a set money value but to change the pay. 'ABC' is a ridiculous, and cryptic pay system. Last I inquired, most agents at the Lacey Xerox site are at $11/hour combined average with ABC/subsidized. A base pay of $14 would be reasonable and understandable that from the moment all agents walk in till they leave they are getting paid or even minimum wage as base pay then 'ABC' for inbound calls, if we must still have 'ABC'. Hope all this information helps some way.

Patrick, you are correct that JND was publishing mistaken information. Toby talked to them and they are correcting it.
Collectively, we have represented others against ACS in the past. Mary Sump sued over ABC pay and that settled in about 2010, and Tysheka Richard sued in 2012 for a national class but that case was dismissed because federal law is not as strong as Washington law.

I am going to escalate with the United States Post Office because I didn't get that information. I have kept up with the "production minutes'' / timekeeping (on-call vs. time spent at the job/follow-ups/outbound, breaks and logging in) + minimum wage laws instead of "piece work" on the case; thanks for that information. I know more evidence came about est. 2018 plus in 2017: I saw the 14-36029 Tiffany Hill v. Xerox Business Services from the United States Court of Appeals for the Ninth Circuit. Thank you for confirming I am part of this case / employment history and my address is up to date.
What I find interesting is when we started years ago, I remember another individual (I believe a woman) who was on the plaintiff's side (with Tiffany Hill vs. Xerox/ACS), whatever happened to her?

Subject: Hill vs Xerox / ACS
Dear BJT and co-counsel Toby Marshal,
I have a few questions about the Class Action Lawsuit against Xerox Business Services, LLC / ACS / LiveBridge, Inc. Case No. C12-0717-JCC. I was a former employee and multiple time rehire/re-trained representative. I am well aware of some of their shady practices, including after call work and not being allowed to "toggle" to avoid getting on-call (although that is how we get paid); mostly so we can do follow-up case work / research or turning on equipment/logging in. (All that takes extra time. Plus from est. 2013 onward we had a new time-clock system added on top of the old, called Kronos in which we could view our timesheets.)
As of est. 2018 (known as Continuum Global Solutions LLC - and in 2017 Conduent/Xerox), Kronos timekeeping system no longer supported swiping your badge/ID to login and you must type in your ID number manually. Sometimes mistyping or other people logging into yours and then having to wait to get logged back in or timeout while viewing your timesheet. As of Fall 2019, they took away "updated" features to view your timesheets and now you can only log in or out with nothing to verify. I was advised to just remember your times as it's a "paperless" secured environment; not allowed to write anything down and not allowed to bring electronics/recording devices into the production area.
LACEY: We're also affected by the COVID-19 pandemic, forced temp. closure and hiring freeze of the call centers as "non-essential" in Washington state (Gov. Jay Inslee announces "Stay Home, Stay Healthy" order; many of my colleagues are still affected also.)
I was an employee during 'pay-per-call' days with LiveBridge Inc (then they changed names to ACS) in 2006 at 148 Tumwater Blvd, Tumwater, WA 98501, then rehired with ABC in 3/13/2012 (ACS then they changed names to Xerox at 8535 Commerce Place Drive NE, Lacey, WA 98516) and I stayed employed through my disability claim in June 2016, having both the RBC pay structure and an experimental pay-pilot before they changed it for everyone (using metlife short-term/long-term disability est up to two years est. Jan 2018; need to reference old documents for exact dates).
I returned to work after receiving a favorable decision for Social Security Disability / Ticket To Work in June 2019, signed up for their Unum insurance for taking extended breaks / LOA and disability claims; until January 2020 (also when everyone started getting sick/calling out) when I was laid-off, no fault of my own. (I tried to contact HR / applied for a better job and even filed for a lawsuit with L&I to get my job back and proper pay as I was lied to from being re-trained treated as a "new employee" / lower pay than discussed but it wasn't favorable and they even got a lawyer against me who sent me a 'cease and desist' of contacting / 'discussing' with corporate/others about my termination/income. I also am attempting to file with the Human Rights Commision on discrimination grounds. I've rebutted each case but still waiting to hear if anything gets overturned/accomplished.

Hill v. Xerox Business Services
On December 17, 2019, the Court approved the class notice in a class action lawsuit, Hill v. Xerox Business Services, LLC, Case No. C12-0717-JCC (U.S. District Court, Western District of Washington). The settlement provides for people who worked at a Xerox Business Services or Livebridge call center in Washington at any time between June 5, 2010 to January 3, 2020, under an “Activity Based Compensation” or “ABC” plan that paid “per minute” rates for certain work activities. The case website will be updated once the Court approves the settlement and as the administration progresses. The deadline to opt-out of the settlement passed on February 18, 2020.
What has come of this case and may I get some updates for my records?
